Terms of Service - Brann Fizzard, "Raven Lunatic Art"


By purchasing services from me, you are agreeing to the following conditions marked below. Please read this document carefully and in its entirety before proceeding to commission me.

If I have reason to believe you have not read this document, your commission will be cancelled without refund if applicable.

General Terms

I, the artist, retain the right to refuse a commission without reason.

I, the artist, retain the copyright to the work as stated under the Canadian Copyright Act; I have the sole right of reproduction to use as promotion for myself and my website(s). If clients wish to discuss the copyright of their commission, please do so BEFORE the work has been approved.

You cannot alter my work without my permission.If there is a mistake in the work, inform me so we can discuss a fix.

If I feel the client has disrespected myself and my work the client may be added to a Blacklist, meaning they are barred from commissioning me in the future.

I WILL NOT create work for the purposes of AI training or the production of NFTs. If I find a client has done so with one or more of my works they will be Blacklisted and may have legal action brought against them.

Declaratives of “I” or “Me” with refer to the artist, Raven Lunatic Art, for the remainder of this document.

Declaratives of “client” refer to the individual paying Raven Lunatic Art for the remainder of this document.

1. Artist Terms

All artwork belongs to me. If the client denies the thumbnail or rough sketch, they do not retain the copyright to the sketch image. It remains my property until the work is completed or otherwise discussed by the client and myself.

I will send an update of your commission more than once during production of the work (depending on complexity of piece). This is to insure accuracy and clarity of the progress of the work. If there is anything incorrect during this process please reach out to me. 

Once I begin the finalizing phase of the work, I will no longer accept changes to the work. Examples: Changing the character, background OR changes that would change 30-100% of work.

Turn around varies depending on my professional schedule and the nature of the commission. Keep in mind, I work a full-time job, am an exhibiting artist, this greatly decreases the free time available to spend on freelance work. Large scale works may take weeks to months while smaller works may take days to a couple weeks. I will continually update the client with the current schedule of my life. 

2. Commissioner Terms

The client retains the rights to the characters depicted in my artwork (in the case of character commissions). 

The client is encouraged to stay in contact about their piece and ask for updates.

It is the client’s job to inform me about errors in design or issues they have with the work before the finalizing phase. If no critique is given I will decide the work is fine and move on with completion.

It is the client's job to inform me, the artist, about difficulties with payment or changes in payment ability.

If the client desires a payment plan that is specific to their needs, they must make this known and communicate this need with me so we can discuss methods of payment.

The client may use the commissioned piece for personal non-commercial purposes. Examples include; Social media profiles, framed artwork within their home, ect. If the client would like me to print their work with archival materials, an extra fee will be incurred for printing/shipping.

3. Payment

All Prices are in Canadian (CAD)

For those within Canada: Payment(s) is to be made through eTransfer or Square via invoice.

For those outside Canada: Payment(s) to be made with Square via invoice.

For works below $30.00, I expect payment upfront and in full. For works $30.00 and above, I will accept half upfront and half upon confirmation of a watermarked version of the inking/finalization phase. This will be communicated with the client in advance of payment.

Clients may be charged an extra fee for things such as: Complicated character designs, New or experimental work, large scale changes, printing of the commission and priority deadlines. This will be discussed by the client and myself in advance of payment.

If a commission is cancelled before completion,I have the right to retain partial payment based on the amount of work completed.

If the client cannot make a payment due to extenuating circumstances, they are expected to communicate with me on a course of action. If no contact is made by the client, I will expect payment. If payment is not made, the commission will be cancelled and the client flagged, or blacklisted.

4. Refunds

I reserve the right to cancel a commission without reason. If cancellation is due to scheduling problems on my behalf, all funds will be issued back to the customer.

You may ask for a refund, before or after the commission has been started. However, I have the right to keep a portion of the payment based on the amount of work completed on the project before cancellation.

I will not accept refunds after the work has been completed.

5. Commission Process

Upon accepting the commission, it will go through the following phases:

1.      Sketch and refinement

2.      First payment due

3.      Inking/finalization*

4.      Colour/Shading*

5.      Background/cohesion*

6.      Final check in with customer

7.      Final Payment

6. Subject Matter

I am open to a variety of themes, tones, and subject matter within my practice. If you are curious about something not listed below, please feel free to contact me and inquire.


Will Draw

-Artistic Freedom commissions (where I am given free range to create as I please)

-Animals: feral, anthropomorphic/furries,mythical, etc.

-Monsters/non-human creatures

-Characters with written description but no art (with extra fee)

-Fantasy/Sci-fi

-Humanoids/Aliens (with extra fee)

-Mechanical objects/beings, or man-made structures (with extra fee)

-Artistic Nudity or Suggestive Pin Ups

-Horror/Gore (May be posted onto separate account)

-NSFW/sexual themes (Will be posted onto separate account)


Will Deny

-Characters in which I do not believe I have the skill to draw accurately

-Imagery or themes condoning hate speech and/or violence towards minority groups

-Some NSFW themes (Please inquire about specific things)

-Large Age Gaps/Pedophilia

-Zoophilia

-Fetishization of minority groups

-Politics

-Glorification of War, Police, Military. I believe in ACAB, I will blacklist commissioners who do not, or, lie that they do. My work is not for people complacent to the suffering and oppression of minority groups, period.
